1. Acceptance of Terms

Welcome to Yomio. By accessing or using our mobile application ("App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the App. By creating an account, you confirm that you have read, understood, and accepted these Terms and our Privacy Policy. We record the version of these Terms you accepted and the date of acceptance.

2. Description of Service

  • Receipt Scanning: Advanced OCR technology to scan and digitize paper receipts
  • Item-Level Detail: Extraction of individual items, prices, and quantities from receipts
  • Automatic Categorization: AI-powered categorization of purchases and items
  • AI Assistant (Copilot): An AI-powered chat assistant for spending analysis and purchase insights
  • Purchase History: Digital storage and organization of all scanned receipts
  • Analytics: Spending insights, trends, and reports
  • Family Sharing: Ability to share expense tracking with family members (Premium)
  • Cloud Synchronization: Cross-device data synchronization
  • Data Export: Export capabilities for purchase data (Premium)

3. Account Registration

3.1 Account Creation

  • Be at least 16 years old if you reside in the European Economic Area, or at least 13 years old in all other jurisdictions
  • Provide accurate and complete registration information
  • Maintain and update your account information
  • Keep your password secure and confidential
  • Accept responsibility for all activities under your account

3.2 Account Security

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access
  • Ensuring your device security, including biometric authentication settings

4. Subscription Plans and Payments

4.1 Free Tier

  • Up to 15 receipts (trial)
  • Basic receipt scanning and categorization
  • 6 months of data retention
  • Basic monthly reports

4.2 Premium Subscription

We will notify you at least 30 days in advance of any price changes to your subscription. You may cancel your subscription without penalty before the new price takes effect.

4.3 Subscription Management and Payments

Management

  • You can upgrade or downgrade your subscription at any time through your App Store or Google Play account settings
  • Subscription changes take effect on the next billing cycle
  • You can cancel your subscription at any time; no refunds are issued for the current billing period
  • Upon cancellation, you retain access to Premium features until the end of your current billing period

Payment Processing

  • Payments are processed through Apple App Store or Google Play Store
  • Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
  • You will be charged within 24 hours prior to the end of the current period
  • Subscription management is handled through your App Store or Google Play account settings

4.4 Refund Policy

  • Monthly subscriptions: 14-day refund window from the time of purchase. EU/EEA consumers are entitled to a 14-day statutory right of withdrawal under the EU Consumer Rights Directive (2011/83/EU), which applies regardless of billing period.
  • Annual subscriptions: 14-day refund window from the time of purchase
  • Refund requests must be submitted through Apple App Store or Google Play Store within the applicable refund period
  • Refunds are processed through Apple App Store or Google Play Store according to their respective refund policies
  • Refund eligibility is governed by each platform's refund policy and terms of service
  • We comply with applicable refund policies and consumer protection laws in your jurisdiction
  • For refund inquiries, contact support through the App or visit the respective app store's support portal

5. User Responsibilities and Acceptable Use

5.1 Permitted Use

  • Personal expense tracking and financial management
  • Scanning and storing your own receipts
  • Sharing expenses with family members through the Family Sharing feature
  • Generating reports for personal or tax purposes

5.2 Prohibited Activities

  • Upload fraudulent, altered, or fake receipts
  • Share your account credentials with others
  • Reverse engineer, decompile, or disassemble the App
  • Use the App for illegal activities or money laundering
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Upload malicious code, viruses, or harmful content
  • Use automated scripts or bots to interact with the App
  • Resell, redistribute, or sublicense the App or services
  • Remove, obscure, or alter any proprietary notices
  • Use the App in a way that violates any applicable laws or regulations

6. Intellectual Property

6.1 Our Intellectual Property

The App, including all content, features, functionality, software, designs, text, graphics, logos, and trademarks, is owned by Yomio and is protected by international copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the App other than the limited right to use it in accordance with these Terms.

6.2 Your Content

You retain full ownership of any content you upload to the App, including receipt images and purchase data. By uploading content, you grant Yomio a limited, non-exclusive, royalty-free, worldwide license to process, store, analyze (including via OCR and AI), and display your content solely for the purpose of providing and improving the Service. This license terminates when you delete your content or account.

6.3 Feedback

If you provide feedback, suggestions, or ideas about the App, you grant us a non-exclusive, perpetual, irrevocable, royalty-free license to use such feedback solely in connection with the improvement, operation, and promotion of the App, without compensation or attribution to you.

7. Termination

7.1 Termination by You

You may terminate your account at any time by deleting your account through the App settings. We recommend exporting your data (via App settings → Export) before requesting deletion, as account deletion is permanent and cannot be undone. Upon account deletion, all your personal data, receipt images, purchase history, and AI conversation data will be permanently erased from our systems. If you have an active Premium subscription, you must cancel it separately through the Apple App Store or Google Play Store.

7.2 Termination by Us

We may suspend or terminate your account and access to the App, with or without notice, if:

  • You violate any provision of these Terms
  • You engage in prohibited activities as described in Section 5.2
  • Your use of the App poses a security risk to us or other users
  • We are required to do so by law or regulation
  • We discontinue the App or Service (with reasonable prior notice)

7.3 Effect of Termination

Upon termination, your license to use the App immediately ceases. Sections 6 (Intellectual Property), 8 (Limitation of Liability), 9 (Warranty Disclaimer), 10 (Indemnification), and 12 (Governing Law) survive termination.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Yomio and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or in connection with your use of the App. Our total aggregate liability for all claims arising under these Terms shall not exceed the amount you have paid to us in the twelve (12) months preceding the event giving rise to the liability, or fifty euros (€50), whichever is greater. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law. If you are a consumer in the European Economic Area, these limitations apply only to the extent permitted by applicable consumer protection laws.

9. Warranty Disclaimer

The App is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or secure, or that any defects will be corrected. Receipt scanning and AI-powered categorization are provided for convenience and may contain errors. You are responsible for verifying the accuracy of extracted data. If you are a consumer in the European Economic Area, you have statutory rights under applicable consumer protection laws, and nothing in this section affects those rights.

10. Indemnification

You agree to indemnify, defend, and hold harmless Yomio and its operator from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use or misuse of the App; (b) your violation of these Terms; (c) your violation of any applicable law or third-party rights; or (d) content you upload to the App, including fraudulent or altered receipts. This indemnification obligation does not apply to the extent that the claim arises from our own negligence or willful misconduct. If you are a consumer in the European Economic Area, this clause applies only to the extent permitted by applicable consumer protection laws, including the EU Unfair Contract Terms Directive (93/13/EEC), and does not impose obligations that would not otherwise exist under applicable law.

11. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email (sent to the address associated with your account) and through an in-app notification at least 30 days before the new Terms take effect. The updated Terms will indicate the new "Last updated" date and version number. Your continued use of the App after the effective date constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the App and delete your account.

12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms are governed by and construed in accordance with the laws of Spain, without regard to its conflict of law provisions.

12.2 Jurisdiction

Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Madrid, Spain. If you are a consumer residing in the European Economic Area, you may also bring proceedings in the courts of your country of residence in accordance with applicable EU consumer protection regulations. Nothing in these Terms affects your rights as a consumer under mandatory local law.

12.3 Online Dispute Resolution

If you are a consumer in the European Union, you may use the European Commission's Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr to resolve disputes online.

13. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms if such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, power outages, internet or telecommunications failures, cyberattacks, pandemics, or third-party labour disputes.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Yomio regarding your use of the App, and supersede all prior agreements and understandings.

14.2 Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.

14.3 No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

14.4 Assignment

You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
