These Terms and Conditions ("Terms") govern the use of Yomio, a mobile application developed and operated by Artsiom Hontar, registered as a sole proprietor (Autónomo) in Spain. The App is distributed globally through the Apple App Store and Google Play.

1. Acceptance of Terms

Welcome to Yomio. By accessing or using our mobile application ("App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you and Yomio regarding your use of the App and services we provide.

2. Description of Service

Yomio is an expense tracking application that provides the following features:

  • Receipt Scanning: Advanced OCR technology to scan and digitize paper receipts
  • Item-Level Detail: Extraction of individual items, prices, and quantities from receipts
  • Automatic Categorization: AI-powered categorization of purchases and items
  • Purchase History: Digital storage and organization of all scanned receipts
  • Analytics: Spending insights, trends, and reports
  • Family Sharing: Ability to share expense tracking with family members (Premium)
  • Cloud Synchronization: Cross-device data synchronization
  • Data Export: Export capabilities for purchase data (Premium)

3. Account Registration

3.1 Account Creation

To use Yomio, you must:

  • Be at least 13 years old (16 in the EEA)
  • Provide accurate and complete registration information
  • Maintain and update your account information
  • Keep your password secure and confidential
  • Accept responsibility for all activities under your account

3.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access
  • Ensuring your device security, including biometric authentication settings

4. Subscription Plans and Payments

4.1 Free Tier

The free version of Yomio includes:

  • Up to 30 receipts per month
  • Basic receipt scanning and categorization
  • 6 months of data retention
  • Basic monthly reports

4.2 Premium Subscription

Premium subscriptions are available as:

  • Monthly Plan: $4.99/month, billed monthly
  • Annual Plan: $47.99/year, billed annually

Premium features include:

  • Unlimited receipt scanning
  • Advanced analytics and spending insights
  • Family sharing for up to 6 members
  • Unlimited data retention
  • Export options (PDF, CSV)
  • Priority customer support
  • Advanced categorization with custom rules
  • Budget tracking and alerts

4.3 Free Trial

New users can try Premium features for free. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically begin, and you will be charged the applicable subscription fee.

4.4 Payment Processing

  • Payments are processed through Apple App Store or Google Play Store
  • Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
  • You will be charged within 24 hours prior to the end of the current period
  • Subscription management is handled through your App Store or Google Play account settings

4.5 Refunds

Refunds are subject to Apple App Store and Google Play Store policies. Generally, all subscription fees are non-refundable except as required by law. To request a refund, contact Apple or Google Play support directly.

5. User Responsibilities and Acceptable Use

5.1 Permitted Use

You may use Yomio for:

  • Personal expense tracking and financial management
  • Scanning and storing your own receipts
  • Sharing expenses with family members through the Family Sharing feature
  • Generating reports for personal or tax purposes

5.2 Prohibited Activities

You may NOT:

  • Upload fraudulent, altered, or fake receipts
  • Share your account credentials with others
  • Reverse engineer, decompile, or disassemble the App
  • Use the App for illegal activities or money laundering
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Upload malicious code, viruses, or harmful content
  • Use automated scripts or bots to interact with the App
  • Resell, redistribute, or sublicense the App or services
  • Remove, obscure, or alter any proprietary notices
  • Use the App in a way that violates any applicable laws or regulations

6. Data and Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using Yomio, you consent to:

  • Collection and processing of receipt images and purchase data
  • Use of AWS Textract for OCR processing
  • Storage of data in AWS cloud infrastructure
  • Use of AI/ML for automatic categorization
  • Data sharing with family members you explicitly invite

Yomio complies with the General Data Protection Regulation (EU) 2016/679 ("GDPR"). Users in the European Economic Area (EEA) have specific rights regarding access, correction, deletion, and portability of their data, as described in our Privacy Policy.

7. Intellectual Property Rights

7.1 Our Rights

The App, including all content, features, functionality, source code, algorithms, and visual design, is owned by Yomio and protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

7.2 Your Rights

You retain all rights to the receipt images and purchase data you upload. By using the App, you grant us a limited license to:

  • Process your receipt images using OCR technology
  • Store and display your purchase data
  • Use anonymized, aggregated data to improve our services

8. Third-Party Services and Integrations

Yomio integrates with the following third-party services:

  • Amazon Web Services (AWS): Cloud infrastructure (S3, Textract, RDS, Cognito) used to store and process receipt images and app data
  • AWS Textract: Optical character recognition for receipt scanning and extraction of structured receipt data
  • Qonversion: Subscription and entitlement management used in-app; billing occurs through Apple App Store or Google Play
  • Apple Sign In / Google Sign In: Optional authentication methods provided by the platform
  • Mixpanel: Analytics provider used to understand app usage (subject to user consent)

Your use of these services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of these third-party services.

9. Disclaimers and Limitations

9.1 Service Availability

While we strive for high availability, we do not guarantee that:

  • The App will be available at all times or without interruption
  • OCR scanning will be 100% accurate for all receipts
  • Automatic categorization will always be correct
  • The App will be error-free or secure from cyber threats

9.2 OCR Accuracy

Receipt scanning uses advanced OCR technology, but accuracy depends on receipt quality, lighting conditions, and other factors. You are responsible for reviewing and correcting scanned data. Yomio is not liable for errors in OCR processing.

9.3 Financial Advice Disclaimer

Yomio provides expense tracking tools and analytics but does not provide financial, tax, or accounting advice. You should consult with qualified professionals for financial guidance.

9.4 "AS IS" Warranty

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOMIO SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or use
  • Errors or inaccuracies in OCR processing
  • Unauthorized access to your account or data
  • Interruption or termination of services
  • Third-party services or content

Our total liability shall not exceed the amount you paid for the subscription in the 12 months preceding the claim, or $50, whichever is greater.

11. Termination

11.1 Termination by You

You may terminate your account at any time by:

  • Deleting your account through the App settings
  • Contacting our support team
  • Canceling your subscription through App Store or Google Play

11.2 Termination by Us

We may suspend or terminate your account if:

  • You violate these Terms
  • You engage in fraudulent or illegal activities
  • Your payment method fails
  • We are required to do so by law
  • We discontinue the service

11.3 Effect of Termination

Upon termination, your right to use the App ceases immediately. Your data will be retained according to our data retention policies. Free tier data is deleted after 6 months of inactivity. Premium data is retained according to your subscription status.

12. Apple App Store and Google Play Terms

12.1 Apple App Store

If you access Yomio through the Apple App Store:

  • These Terms are between you and Yomio, not Apple
  • Apple has no obligation to provide support services
  • Apple is not responsible for addressing any claims related to the App
  • Apple is a third-party beneficiary of these Terms
  • You must comply with Apple's App Store Terms of Service

12.2 Google Play Store

If you access Yomio through Google Play:

  • These Terms are between you and Yomio, not Google
  • Google has no obligation to provide support services
  • Google is not responsible for the App or its content
  • You must comply with Google Play's Terms of Service

13. Updates and Changes

We may update the App and these Terms from time to time. Updates may include:

  • New features and functionality
  • Bug fixes and performance improvements
  • Security patches
  • Changes to subscription plans or pricing (with notice)

Continued use of the App after updates constitutes acceptance of the revised Terms. Material changes will be communicated through the App or email.

14. Governing Law and Dispute Resolution

14. International Use

Yomio is operated from Spain but is available globally through the Apple App Store and Google Play. You are responsible for compliance with local laws in your jurisdiction when using the App. If any part of these Terms is inconsistent with mandatory local consumer protection laws, such provisions shall be modified to comply with such laws.

14.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the Kingdom of Spain, without regard to conflict of law principles. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Madrid, Spain.

14.2 Dispute Resolution

Any disputes arising from these Terms or your use of the App should be resolved through:

  • Good faith negotiation
  • Mediation (if negotiation fails)
  • Binding arbitration (if mediation fails)

You agree to waive any right to a jury trial or to participate in a class action lawsuit.

Consumers within the European Union may also be entitled to use the European Commission's Online Dispute Resolution platform (ODR) available athttps://ec.europa.eu/consumers/odr.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Yomio.

15.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of such right or provision.

15.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
